On October 6, 2009, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Hybrid Electric Vehicles and Components Thereof (Inv. No. 337-TA-688).

According to the Notice of Investigation, the investigation is based on a September 2, 2009 complaint and September 24, 2009 letter amending the complaint filed by Paice LLC of Bonita Springs, Florida.  The complaint alleges violation of Section 337 in the importation into the U.S., the sale for importation, and the sale within the U.S. after importation of certain hybrid electric vehicles and components thereof by reason of infringement of certain claims of U.S. Patent No. 5,343,970.  See our September 8 post for more details.

Further, the Commission has identified the following  as respondents in this investigation:

  • Toyota Motor Corporation of Japan

  • Toyota Motor North America, Inc. of New York, New York

  • Toyota Motor Sales U.S.A., Inc. of Torrance, California

Additionally, Erin Joffre of the Office of Unfair Import Investigations is the Investigative Attorney assigned to handle this investigation.
