Further to our July 8 post indicating that the Commission decided to remand the investigation to the ALJ, on July 20, 2009 ALJ Theodore R. Essex issued Order No. 21 and Order No. 22 in Certain Refrigerators and Components Thereof (Inv. No. 337-TA-632). In Order No. 21, ALJ Essex issued an initial determination extending the target date to February 9, 2010 and setting a due date of October 9, 2009 for the remand initial determination. In Order No. 22, ALJ Essex set the procedural schedule for the remand proceedings. In the Order, ALJ Essex found that “[a]bsent a showing of good cause, … the record need not be reopened and that the remand proceedings can proceed on the evidence already in the record.” The Order sets August 7, 2009 as the due date for initial remand briefs, proposed findings of fact, and conclusions of law, with reply briefs, objections and rebuttal findings of fact due on August 21.
