ITC Institutes Investigation (337-TA-729) Regarding Certain Semiconductor Products
On July 21, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Semiconductor Products Made By Advanced Lithography Techniques And Products Containing Same (Inv. No. 337-TA-729).
The investigation is based on a June 23, 2010 complaint and July 15, 2010 supplement to the complaint filed by STC.UNM of Albuquerque, New Mexico alleging violation of Section 337 in the importation into the U.S. and sale of certain semiconductor products made by advanced lithography techniques and products containing the same which infringe U.S. Patent No. 6,042,998. According to the Notice of Investigation, the ITC has identified Taiwan Semiconductor Manufacturing Company Limited of Taiwan and Samsung Electronics Company Limited of South Korea as the respondents in this investigation.
Additionally, Thomas S. Fusco of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.
Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that ALJ Robert K. Rogers, Jr. will be the presiding Administrative Law Judge in this investigation.
