ITC Institutes Investigation (337-TA-734) Regarding Certain Adjustable-Height Beds
On September 2, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Adjustable-Height Beds and Components Thereof (Inv. No. 337-TA-734).
The investigation is based on an August 5, 2010 complaint filed by Invacare Corporation of Elyria, Ohio alleging violation of Section 337 in the importation into the U.S. and sale of certain adjustable height beds and components thereof that infringe certain claims of U.S. Patent Nos. 6,983,495, 6,997,082, 7,302,716, and 7,441,289. According to the Notice of Investigation, the ITC has identified Medical Depot, Inc., d/b/a Drive Medical Design and Manufacturing of Port Washington, New York and Shanghai Shunlong Physical Therapy Equipment Co., Ltd. of Shanghai, China as respondents in this investigation.
Additionally, Jeffrey T. Hsu of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.
Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that ALJ Carl C. Charneski will be the presiding Administrative Law Judge in this investigation.
