ALJ Rogers Sets Target Date In Certain Drill Bits (337-TA-844)

Further to our May 30, 2012 and June 11, 2012 posts, on June 12, 2012, ALJ Robert K. Rogers, Jr. issued Order No. 6 in Certain Drill Bits and Products Containing the Same (Inv. No. 337-TA-844).

According to the Order, ALJ Rogers set November 4, 2013 as the target date (which is 17 months after institution of the investigation).  ALJ Rogers further indicated that the initial determination on alleged violation shall be due on July 3, 2013.

ALJ Rogers determined that there is good cause for setting a 17-month target date in this investigation since “[t]his investigation includes four respondents, three patents and 30 claims at issue, and it is complex.”  Also, ALJ Rogers determined that if this investigation is scheduled on a 16-month schedule, that schedule would result in three Initial Determinations due within a four-week period.  Accordingly, ALJ Rogers found that it is necessary to schedule the current investigation on a 17-month schedule to adequately space the three Initial Determinations apart from each other.
