ITC Institutes Investigation (337-TA-871) Regarding Certain Wireless-Communication Base Stations

On February 25, 2013, the U.S. International Trade Commission issued a press release announcing their vote to institute an investigation of Certain Wireless-Communication Base Stations and Components Thereof (Inv. No. 337-TA-871).

The investigation is based on a January 24, 2013 complaint filed by Adaptix, Inc. of Carrolton, Texas alleging violation of Section 337 in the importation into the U.S. and sale of certain wireless communications base stations and components thereof that infringe certain claims of U.S. Patent No. 6,870,808.  See our January 25, 2013 post for more details on the complaint.

According to the Notice of Investigation, the Commission has identified Telefonaktiebolaget LM Ericsson of Sweden and Ericsson, Inc. of Plano, Texas as the respondents in this investigation. 

Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that Theodore R. Essex will be the presiding Administrative Law Judge in this investigation.
