On September 7, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Flash Memory Chips and Products Containing The Same (Inv. No. 337-TA-735).

The investigation is based on an August 6, 2010 complaint filed by Spansion LLC of Sunnyvale, California alleging violation of Section 337 in the importation into the U.S. and sale of certain flash memory chips and downstream products containing those chips which infringe certain claims in U.S. Patent Nos. 7,018,922, 6,900,124, 6,459,625, and 6,369,416.  See our August 11, 2010 post for more details.

According to the Notice of Investigation, the ITC has identified the following entities as respondents in this investigation:

  • Samsung Electronics America, Inc. of Ridgefield Park, New Jersey

  • Samsung International, Inc. of San Diego, California

  • Samsung Semiconductor, Inc. of San Jose, California

  • Samsung Telecommunications America, LLC of Richardson, Texas

  • Apple, Inc. of Cupertino, California

  • Nokia Corp. of Finland

  • Nokia Inc. of Irving, Texas

  • PNY Technologies, Inc. of Parsippany, New Jersey

  • Research In Motion Ltd. of Canada

  • Research in Motion Corporation of Irving, Texas

  • Transcend Information Inc. of Taiwan

  • Transcend Information Inc. (US) of Orange, California

  • Transcend Information Inc. (Shanghai Factory) of China


Additionally, Stephen R. Smith of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.

Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that ALJ Robert K. Rogers, Jr. will be the presiding Administrative Law Judge in this investigation.
