Further to our November 5, 2010 post, on December 14, 2010, Chief ALJ Paul J. Luckern issued Order No. 4 in Certain Wireless Communication Devices, Portable Music And Data Processing Devices, Computers and Components Thereof (Inv. No. 337-TA-745).

According to the Order, ALJ Luckern set March 8, 2012 as the target date (which is 16 months after institution of the investigation).  ALJ Luckern further determined that any final initial determination on violation should be filed no later than November 8, 2011 and the evidentiary hearing will commence on July 25, 2011.

The Order also directs the parties to submit a proposed procedural schedule by no later than December 16, 2010.

Lastly, ALJ Luckern determined in the Order that “having reviewed Apple’s discovery statement and the supplemental discovery statements of complainant and the staff and in view of the number of patents and claims in issue and the technologies in issue there will be no Markman hearing.  The parties, however, should include in their procedural schedules dates for the exchange of disputed claim terms in issue, and exchange of proposed claim constructions.”
