On April 19, 2011, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Handheld Electronic Computing Devices, Related Software, And Components Thereof (Inv. No. 337-TA-769).

The investigation is based on a March 21, 2011 complaint and an amended complaint and additional exhibits filed on April 8 and 12, 2011 by Microsoft Corporation of Redmond, Washington alleging violation of Section 337 in the importation into the U.S. and sale of certain handheld electronic computing devices, related software, and components thereof that infringe one or more claims of U.S. Patent Nos. 5,778,372, 5,889,522, 6,339,780, 6,891,551, and 6,957,233.  See our March 23, 2011 post for more details.

According to the Notice of Investigation, the ITC has identified the following as respondents in this investigation:

  • Barnes & Noble, Inc. of New York, New York

  • barnesandnoble.com LLC of New York, New York

  • Hon Hai Precision Industry Co., Ltd. of Taiwan

  • Foxconn Electronics, Inc. of Taiwan

  • Foxconn Precision Component (Shenzhen) Co. Ltd. of China

  • Foxconn International Holdings Ltd. of Hong Kong

  • Inventec Corporation of Taiwan


Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that Theodore R. Essex will be the presiding Administrative Law Judge in this investigation.
