On February 22, 2012, the U.S. International Trade Commission issued a press release announcing their vote to institute an investigation of Certain Electronic Devices For Capturing and Transmitting Images, and Components Thereof (Inv. No. 337-TA-831).

The investigation is based on a January 10, 2012 complaint and January 11 and February 10, 2012 letters supplementing the complaint filed by Eastman Kodak Company of Rochester, New York alleging violation of Section 337 in the importation into the U.S. and sale of certain electronic devices for capturing and transmitting images and components thereof that infringe one or more claims of U.S. Patent Nos. 7,210,161, 7,742,084, 7,453,605, 7,936,391, and 6,292,218.  See our January 13, 2012 post for more details.

According to the Notice of Investigation, the ITC has identified Apple, Inc. of Cupertino, California, High Tech Computer Corp. a/k/a HTC Corp. of Taiwan, HTC America, Inc. of Bellevue, Washington, and Exedea, Inc. of Houston, Texas as the respondents in this investigation.

Additionally, Chief ALJ Charles E. Bullock issued a notice indicating that E. James Gildea will be the presiding Administrative Law Judge in this investigation.
