On March 29, 2017, ALJ David P. Shaw issued Order No. 5 in Certain Hybrid Electric Vehicles and Components Thereof (Inv. No. 337-TA-1042).

By way of background, this investigation is based on a February 2, 2017 complaint filed by Paice LLC and the Abell Foundation, Inc. alleging violation of Section 337 by way of unlawful importation into the U.S., selling for importation, and/or selling within the U.S. after importation certain hybrid electric vehicles and components thereof that infringe one or more claims of U.S. Patent Nos. 7,104,347; 7,237,634; 7,455,134; 7,559,388; and 8,214,097. See our February 6, 2017 and March 8, 2017 posts for more details on the complaint and Notice of Investigation, respectively.

According to the Order, ALJ Shaw set the procedural schedule for the investigation. More particularly, ALJ Shaw determined that the Markman hearing will take place on July 26, 2017; the evidentiary hearing will take place on November 2-7, 2017; the initial determination shall be issued no later than March 9, 2018; and the target date for completing this investigation is July 10, 2018.
