On April 12, 2017, the U.S. International Trade Commission (“Commission”) issued a press release announcing their vote to institute an investigation of Certain Digital Cable And Satellite Products, Set-Top Boxes, Gateways and Components Thereof (Inv. No. 337-TA-1049).

By way of background, this investigation is based on a March 10, 2017 complaint filed by Sony Corporation of Japan and Sony Electronics Inc. of San Diego, California alleging violation of Section 337 by way of unlawful importation into the U.S., selling for importation, and/or selling within the U.S. after importation certain digital cable and satellite products, set-top box products, and gateway products that infringe one or more claims of U.S. Patent Nos. RE45,126; 6,467,093; 8,032,919; 6,556,221; and 6,915,525.  See our March 15, 2017 post for more details on the complaint.

According to the Notice of Investigation, the Commission has identified ARRIS International plc, ARRIS Group, Inc., ARRIS Enterprises LLC, and ARRIS Solutions, Inc. (all of Suwanee, Georgia); ARRIS Technology, Inc. of Horsham, Pennsylvania; ARRIS Global Ltd. (formerly Pace Ltd.) of West Yorkshire, England; Pace Americas, LLC, Pace Americas Holding, Inc., Pace USA LLC, and Pace Americas Investments, LLC (all of Boca Raton, Florida) as the respondents in this matter.

Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that MaryJoan McNamara will be the presiding Administrative Law Judge in this matter.
