On July 24, 2018, the U.S. International Trade Commission (“Commission”) issued a press release announcing their vote to institute an investigation of Certain Height-Adjustable Desk Platforms and Components Thereof (Inv. No. 337-TA-1125).

By way of background, this investigation is based on a June 22, 2018 complaint filed by Varidesk LLC of Coppell, Texas. On July 3, 12, and 20, 2018, Varidesk filed letters supplementing the complaint. The complaint alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain height-adjustable desk platforms that infringe one or more claims of U.S. Patent No. 9,113,703 (“the ’703 patent”); U.S. Patent No. 9,277,809 (“the ’809 patent”); U.S. Patent No. 9,554,644 (“the ’644 patent”); and U.S. Patent No. 9,924,793 (“the ’793 patent”). Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that Thomas B. Pender will be the presiding Administrative Law Judge in this matter.
