On June 15, 2018, the U.S. International Trade Commission (“Commission”) issued a press release announcing their vote to institute an investigation of Certain Human Milk Oligosaccharides and Methods of Producing the Same (Inv. No. 337-TA-1120).

By way of background, this investigation is based on an April 2, 2018 complaint filed by Glycosyn, LLC of Waltham, Massachusetts. An amended complaint was filed on May 16, 2018. An additional supplement to the complaint was also filed on May 25, 2018. The complaint, as amended and supplemented, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain human milk oligosaccharides that infringe one or more claims of U.S. Patent No. 9,453,230 (“the ’230 patent”) and U.S. Patent No. 9,970,018 (“the ’018 patent”). On June 12, 2018, Walbro, LLC of Tucson Arizona (“Walbro”) filed a complaint (part 1, part 2, part 3, and part 4) requesting that the ITC commence an investigation pursuant to Section 337.

The complaint alleges that the following entities (collectively, the “Proposed Respondents”) unlawfully import into the U.S., sell for importation, and/or sell within the U.S. after importation certain carburetors and products containing same that infringe one or more claims of U.S. Patent Nos. 6,394,424 (the ’424 patent), 6,439,547 (the ’547 patent), 6,533,254 (the ’254 patent), 6,540,212 (the ’212 patent), and 7,070,173 (the ’173 patent) (collectively, the “asserted patents”):

By way of background, this investigation is based on an April 30, 2018 complaint filed by, Bear Archery, Inc. of Evansville, Indiana. The Complaint was amended May 4, 2018. The complaint, as amended, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain full-capture arrow rests that infringe one or more claims of U.S. Patent No. 6,978,775 (“the ’775 patent”). On June 8, 2018, Electrolux Home Products of Charlotte, NC and KX Technologies, LLC of West Haven, CT (collectively, “Electrolux”) filed a complaint requesting that the ITC commence an investigation pursuant to Section 337.

The complaint alleges that Shenzen Calux Purification Technology Co., Limited, Guangzhou Zhixun Xingyi Information Technology Co., Ltd., Ningbo Pureza Limited, Jiangsu Angkua Environmental Technical Co., Ltd., Ecopure Filter Co., Ltd., Shenzhen Dakon Purification Tech Co., Ltd., and HongKong Ecoaqua Co., Limited, each of China, along with Ecolife Technologies, Inc., of City of Industry, California, Ecolife Technologies, LLC of Brighton, Colorado, and Crystala Filters LLC of Patterson, New Jersey (collectively, “Respondents”) unlawfully import into the U.S., sell for importation, and/or sell within the U.S. after importation certain water filters and components thereof, that infringe one or more claims of U.S. Patent Nos. 8,673,146 (“the ’146 patent”), 8,137,551 (“the ’551 patent”), 9,233,322 (“the ’322 patent”) and 9,901,852 (“the ‘852 patent”) (collectively, “Asserted Patents”).

By way of background, this investigation is based on an April 30, 2018 complaint filed by, Anheuser-Busch InBev S.A. of Belgium and Anheuser-Busch, LLC of St. Louis, Missouri. Supplements to the Complaint were filed on May 4, 2018 and May 15, 2018. The complaint, as supplemented, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain blow-molded bag-in-container devices that infringe one or more claims of U.S. Patent No. 9,162,372 (“the ’372 patent”); U.S. Patent No. 9,517,876 (“the ’876 patent”); U.S. Patent No. 9,555,572 (“the ’572 patent”); and 9,944,453 (“the ’453 patent”).
