On May 13, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Digital Imaging Devices and Related Software (Inv. No. 337-TA-717).
The investigation is based on an April 15, 2010 complaint filed by Apple, Inc. of Cupertino, California alleging violation of Section 337 in the importation into the U.S. and sale of certain digital imaging devices and related software that infringe certain claims of U.S. Patent Nos. 6,031,964 and RE 38,911. According to the Notice of Investigation, the ITC has identified Eastman Kodak Company of Rochester, New York as the respondent in this investigation.
Further, Vu Q. Bui of the Office of Unfair Import Investigations is identified on the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.
