On June 11, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Portable Electronic Devices and Related Software (Inv. No. 337-TA-721).

The investigation is based on a May 12, 2010 complaint and June 3, 2010 supplemental letter filed by HTC Corp. of Taiwan alleging violation of Section 337 in the importation into the U.S. and sale of certain portable electronic devices and related software by reason of infringement of certain claims of U.S. Patent Nos. 6,999,800, 5,541,988, 6,058,183, 6,320,957, and 7,716,505.  See our May 14, 2010 post for more details.

According to the Notice of Investigation, the ITC has identified Apple, Inc. of Cupertino, California as the sole respondent in this investigation.

Further, Thomas S. Fusco of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.

Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that ALJ Charles E. Bullock will be the presiding Administrative Law Judge in this investigation.
