On June 11, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Automotive Vehicles and Designs Therefore (Inv. No. 337-TA-722).The investigation is based on a May 14, 2010 complaint and a June 4, 2010 amended complaint filed by Chrysler Group LLC of Auburn Hills, Michigan alleging violation of Section 337 in the importation into the U.S. and sale of certain automotive vehicles and designs therefore by reason of infringement of U.S. Patent No. D513,395. See our May 18, 2010 post for more details.
According to the Notice of Investigation, the ITC has identified Xingyue Group Co., Ltd. of China, Shanghai Xingyue Power Machinery Co., Ltd. of China, Zhejiang Xingyue Vehicle Co. Ltd. of China, Shanghai Tandem Industrial Co., Ltd. of China, Shanghai Xingyue USA, Inc. of City of Industry, California, Boat N RV Supercenter of Rockwood, Tennessee, and Vehicles Online, Inc. of Charlotte, North Carolina as the respondents in this investigation.
Further, Anne Goalwin of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.
Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that ALJ Carl C. Charneski will be the presiding Administrative Law Judge in this investigation.
