On July 2, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Caskets (Inv. No. 337-TA-725).

The investigation is based on a June 8, 2010 complaint filed by Batesville Services, Inc. of Batesville, Indiana alleging violation of Section 337 in the importation into the U.S. and sale of certain caskets that infringe U.S. Patent Nos. 5,611,124, 5,727,291, 6,836,936, 6,976,294, and 7,340,810.  See our June 10, 2010 post for more details.

According to the Notice of Investigation, the ITC has identified Ataudes Aguilares, S. de R.L. de C.V. of Mexico as the respondent in this investigation.

Further, Kevin G. Baer of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.

Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that ALJ Theodore R. Essex will be the presiding Administrative Law Judge in this investigation.
