On July 26, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Toner Cartridges and Components Thereof (Inv. No. 337-TA-731).

The investigation is based on a June 28, 2010 complaint and July 15, 2010 letter supplementing the complaint filed by Canon Inc. of Japan, Canon U.S.A., Inc. of Lake Success, New York and Canon Virginia, Inc. of Newport News, Virginia alleging violation of Section 337 in the importation into the U.S. and sale of certain toner cartridges and components thereof which infringe U.S. Patent Nos. 5,903,803 and 6,128,454.  See our June 30, 2010 post for more details.

According to the Notice of Investigation, the ITC has identified the following entities as respondents in this investigation:

Additionally, Benjamin Levi of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.

Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that ALJ E. James Gildea will be the presiding Administrative Law Judge in this investigation.
