On November 18, 2010, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Automated Media Library Devices (Inv. No. 337-TA-746).

The investigation is based on an October 19, 2010 complaint and November 9, 2010 letter supplementing the complaint filed by Overland Storage, Inc. of San Diego, California alleging violation of Section 337 in the importation into the U.S. and sale of certain automated media library devices that infringe U.S. Patent Nos. 6,328,766 and 6,353,581.  See our October 22, 2010 post for more details.

According to the Notice of Investigation, the ITC has identified BDT AG of Germany, BDT-Solutions GmbH & Co. KG of Germany, BDT Automation Technology (Zhuhai FTZ) Co., Ltd. of China, BDT de México, S. de R.L. de C.V. of Mexico, BDT Products, Inc. of Irvine, California, Dell Inc. of Round Rock, Texas, and International Business Machines Corp. of Armonk, New York as respondents in this investigation.

Additionally, Lisa A. Murray of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.

Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that Charles E. Bullock will be the presiding Administrative Law Judge in this investigation.
