On March 3, 2011, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Radio Control Hobby Transmitters And Receivers and Products Containing Same (Inv. No. 337-TA-763).

The investigation is based on a January 14, 2011 complaint filed by Horizon Hobby, Inc. of Champaign, Illinois alleging violation of Section 337 in the importation into the U.S. and sale of certain radio control hobby transmitters and receivers and products containing same that infringe U.S. Patent No. 7,391,320, U.S. Copyright Registration No. TX-7-226-001, and U.S. Trademark Reg. No. 3,080,770 for the mark SPEKTRUM.  See our January 14, 2011 post for more details.

According to the Notice of Investigation, the ITC has identified Koko Technology Ltd. of China and Cyclone Toy & Hobby of China as the respondents in this investigation.

Further, Thomas S. Fusco of the Office of Unfair Import Investigations is identified in the Notice of Investigation as the Investigative Attorney assigned to handle this investigation.

Lastly, Chief ALJ Paul J. Luckern issued a notice indicating that he will be the presiding Administrative Law Judge in this investigation.
