Further to our April 20, 2011 post, on June 2, 2011, ALJ Theodore R. Essex issued Order No. 3: Setting the Target Date and Date for Submission of Proposed Procedural Schedule in Certain Handheld Electronic Computing Devices, Related Software, And Components Thereof (Inv. No. 337-TA-769).

By way of background, the Complainant in this investigation is Microsoft Corporation of Redmond, Washington.  The Respondents are Barnes & Noble, Inc. of New York, New York, barnesandnoble.com LLC of New York, New York, Hon Hai Precision Industry Co., Ltd. of Taiwan, Foxconn Electronics, Inc. of Taiwan, Foxconn Precision Component (Shenzhen) Co. Ltd. of China, Foxconn International Holdings Ltd. of Hong Kong, and Inventec Corporation of Taiwan.

In the Order, ALJ Essex set August 27, 2012 as the target date for completing the investigation (which is approximately 16 months after institution of the investigation).  Therefore, any final initial determination is due no later than April 27, 2012.

In addition, ALJ Essex directed the parties to submit proposed procedural schedules by June 16, 2011.  ALJ Essex instructed the parties to propose schedules that account for a prehearing conference and tutorial on February 6, 2012, and a hearing that commences on the same day, and concludes no later than February 15, 2012.
