Further to our July 15, 2011 post, on August 2, 2011, ALJ Charles E. Bullock issued Order No. 5 in Certain Digital Televisions and Components Thereof (Inv. No. 337-TA-789).

In the Order, ALJ Bullock set January 21, 2013 as the target date for completing the investigation (which is eighteen months after institution of the investigation) due to the complexity of the asserted technology, the large number of respondents, and the number of claims at issue.

In addition, ALJ Bullock directed the parties to submit discovery statements and proposed procedural schedules by August 8, 2011.  ALJ Bullock further determined in the Order that in light of the complexity of the technology at issue in the investigation, “a Markman hearing will be beneficial and assist in streamlining the issues for the evidentiary hearing.”  In this regard, ALJ Bullock instructed the parties to include provisions in their proposed schedules for the exchange of claim construction expert reports and Markman briefs.  ALJ Bullock also noted that the tutorial will be held on January 10, 2012, the Markman hearing will take place on January 10-11, 2012, and the evidentiary hearing will commence on June 25, 2012.
