On November 8, 2011, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Computing Devices With Associated Instruction Sets And Software (Inv. No. 337-TA-812).

The investigation is based on a September 22, 2011 complaint, an October 13, 2011 amended complaint, and an October 31, 2011 letter further amending the amended complaint filed by VIA Technologies, Inc. of Taiwan, IP-First, LLC of Fremont, California, and Centaur Technology, Inc. of Austin, Texas alleging violation of Section 337 in the importation into the U.S. and sale of certain computing devices with associated instruction sets and software that infringe one or more claims of U.S. Patent Nos. 6,253,312, 6,253,311, 6,754,810, 7,185,180, and 7,155,598.  See our September 23, 2011 post for more details about the original complaint.

According to the Notice of Investigation, the ITC has identified Apple Inc. a/k/a Apple Computer, Inc. of Cupertino, California as the sole respondent in this investigation.

Further, Chief ALJ Charles E. Bullock issued a notice indicating that Thomas B. Pender will be the presiding Administrative Law Judge in this investigation.
