On November 22, 2011, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Wiper Blades (Inv. No. 337-TA-816).

The investigation is based on an October 26, 2011 complaint filed by Robert Bosch LLC of Farmington Hills, Michigan alleging violation of Section 337 in the importation into the U.S. and sale of certain “flat” or “beam-type” wiper blade devices that infringe one or more claims of U.S. Patent Nos. 6,523,218, 6,553,607, 6,611,988, 6,675,434, 6,836,926, 6,944,905, 6,973,698, 7,293,321, and 7,523,520.  See our October 27, 2011 post for more details.

According to the Notice of Investigation, the ITC has identified the following entities as the respondents in this investigation:

  • Alberee Products, Inc. of Baltimore, Maryland

  • API Korea Co., Ltd. of South Korea

  • Cequent Consumer Products, Inc. of Solon, Ohio

  • Corea Autoparts Producing Corporation of South Korea

  • Danyang UPC Auto Parts Co., Ltd. of China

  • Fu-Gang Co., Ltd. of Taiwan

  • PIAA Corporation USA of Portland, Oregon

  • Pylon Manufacturing Corp. of Deerfield Beech, Florida

  • RainEater, LLC of Erie, Pennsylvania

  • Scan Top Enterprise Co., Ltd. of Taiwan

  • Winplus North America Inc. of Ontario, California


Further, Chief ALJ Charles E. Bullock issued a notice indicating that he will be the presiding Administrative Law Judge in this investigation.
