On March 26, 2013, the U.S. International Trade Commission issued a press release announcing their vote to institute an investigation of Certain Radio Frequency Identification (“RFID”) Products and Components Thereof (Inv. No. 337-TA-875).

The investigation is based on a February 22, 2013 complaint and a March 7, 2013 letter supplementing the complaint filed by Neology, Inc. of Poway, California alleging violation of Section 337 in the importation into the U.S. and sale of certain radio frequency identification (“RFID”) products and components thereof that infringe one or more claims of U.S. Patent Nos. 7,081,819, 7,671,746, and 6,690,264.  See our February 25, 2013 post for more details on the complaint.

According to the Notice of Investigation, the Commission has identified Federal Signal Corporation of Oakbrook, Illinois, Federal Signal Technologies, LLC of Irvine, California, Sirit Corp. of Irvine, California, and 3M Company of St. Paul, Minnesota (“3M”) as the respondents in this investigation. 

Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that Robert K. Rogers, Jr. will be the presiding Administrative Law Judge in this investigation.
