On February 2, 2015, ALJ David P. Shaw issued the public version of Order No. 23 (dated January 30, 2015) in Certain Non-Volatile Memory Devices And Products Containing Same (Inv. No. 337-TA-909).

By way of background, this investigation is based on a December 27, 2013 complaint filed by Macronix International Co., Ltd of China and Macronix America, Inc. of Milpitas, California (collectively "Macronix") alleging violation of Section 337 in the importation into the U.S. and sale of certain non-volatile memory devices and products that contain the same that infringe certain claims of U.S. Patent Nos. 6,552,360; 6,100,557; and 6,002,630.  See our December 31, 2013 and January 30, 2014 posts for more details on the complaint and Notice of Investigation, respectively.

According to Order No. 23, ALJ Shaw granted a joint motion filed by the private parties to terminate the investigation based on a confidential settlement agreement entered into by Macronix and the Spansion Respondents which "resolves the dispute underlying the investigation with respect to all respondents."
