On July 28, 2016, ALJ Theodore R. Essex issued Order No. 4 in Certain Air Mattress Bed Systems and Components Thereof (Inv. No. 337-TA-999).

By way of background, this investigation is based on an April 20, 2016 complaint filed by Select Comfort Corporation of Minneapolis, Minnesota and Select Comfort SC Corporation of Greenville, South Carolina alleging violation of Section 337 in the importation into the U.S. and sale of certain air mattress bed systems and components thereof that infringe one or more claims of U.S. Patent Nos. 6,804,848 and 7,389,554. See our April 20, 2016 and May 23, 2016 posts for more details on the complaint and Notice of Investigation, respectively.

According to Order No. 4, ALJ Essex set the procedural schedule.  Specifically, ALJ Essex set the evidentiary hearing to commence on January 30, 2017 and end on February 3, 2017.  Additionally, ALJ Essex determined that the initial determination on violation shall be issued no later than April 24, 2017.
