On August 24, 2017, ALJ Thomas B. Pender issued Order No. 4 in Certain Mobile Electronic Devices and Radio Frequency and Processing Components Thereof (Inv. No. 337-TA-1065).

By way of background, this investigation is based on a July 7, 2017 complaint filed by Qualcomm Inc. of San Diego, California alleging violation of Section 337 by way of unlawful importation into the U.S., selling for importation, and/or selling within the U.S. after importation of certain mobile electronic devices and radio frequency and processing components thereof that infringe one or more claims of U.S. Patent Nos. 8,633,936; 8,698,558; 8,487,658; 8,838,949; 9,535,490; and 9,608,675. According to the Order, ALJ Pender set the procedural schedule for the investigation. Specifically, ALJ Pender determined, inter alia, that the Markman hearing will take place on January 8-9, 2018; the evidentiary hearing will take place on June 11-15, 2018; the initial determination will be issued on September 14, 2018; and the target date for completing the investigation is January 14, 2019 (which is approximately seventeen months after institution of the investigation).
