On October 17, 2017, ALJ Thomas B. Pender issued Order No. 3 in Certain Periodontal Laser Devices and Components Thereof (Inv. No. 337-TA-1070).

By way of background, this investigation is based on an August 10, 2017 complaint filed by Millennium Dental Technologies, Inc. of Cerritos, California alleging violation of Section 337 by way of unlawful importation into the U.S., selling for importation, and/or selling within the U.S. after importation of certain periodontal laser dental devices for sale after importation based on false and misleading marketing, promotion, and distribution practices. See our August 10, 2017 and September 19, 2017 posts for more details on the complaint and Notice of Investigation, respectively.

According to the Order, ALJ Pender set December 14, 2018 as the target date for completing the investigation (which is approximately fifteen months after institution of the investigation). In addition, ALJ Pender noted, inter alia, that the evidentiary hearing shall take place on April 20-27, 2018; and the initial determination will be issued on August 9, 2018.
