On December 14, 2017, ALJ Thomas B. Pender issued Order No. 5 in Certain Amorphous Metal and Products Containing Same (Inv. No. 337-TA-1078).

By way of background, this investigation is based on a September 19, 2017 complaint filed by Metglas, Inc. of Conway, South Carolina and Hitachi Metals, Ltd. of Japan alleging violation of Section 337 by way of unlawful importation into the U.S., selling for importation, and/or selling within the U.S. after importation certain amorphous metal and products containing same, including amorphous metal ribbon (“AMR”) and amorphous cores made from such AMR, that were manufactured using Complainants’ misappropriated trade secrets. See our September 21, 2017 and October 26, 2017 posts for more details on the complaint and Notice of Investigation, respectively.

According to the Order, ALJ Pender set the procedural schedule for the investigation. Specifically, ALJ Pender determined, inter alia, that the evidentiary hearing will take place on October 19-26, 2018; the initial determination will be issued on January 7, 2019; and the target date for completing the investigation is May 7, 2019.
